Environmental Groups Sue State over Delta Pumping

Several environmental and fishing groups filed a lawsuit against the Department of Water Resources and the State Water Resources Control Board Sept. 7 over Delta pumping activities.

The lawsuit, filed by California Water Impact Network, the California Sportfishing Protection Alliance and AquAlliance in Sacramento County Superior Court, alleges violation of the public trust doctrine by allowing too much pumping in the Delta.

The suit states that DWR has failed to comply with several existing water rules and the State Water Resources Control Board has failed to enforce these rules, and calls for an injunction against water diversion from the Bay-Delta until “reasonable water diversions” are established.
