Hearing Set for AB 1955; Opposition Letters Requested

An ACWA-opposed bill that would prohibit public agency board members from holding two public offices simultaneously in certain circumstances will be heard in the Senate Local Government Committee on June 30. 

AB 1955 (De La Torre) prohibits a person from holding two public offices simultaneously if both agencies for which the person holds office have the power of eminent domain and the geographic jurisdictions of the agencies overlap; if either agency has the power to set a fee or rate or to impose a tax or a levy that may directly or indirectly affect the other agency; if either agency has the authority to investigate, monitor, or sue the other agency; and if the law does not explicitly require or authorize service in both positions. The bill would preclude public agency board members from simultaneously serving on a joint powers authority board.

ACWA is urging member agencies to send letters opposing AB 1955 to Senator Dave Cox, chair of the Senate Local Government Committee. Member agencies represented by a senator who serves on the committee are also urged to send letters to their senator. Committee members include Senator Kehoe, Senator Aanestad, Senator De Saulnier and Senator Price.
