The Safe Drinking Water Act requires EPA to propose an MCLG and MCL within 24 months of issuing a regulatory determination. Delaying this action until now has already eroded consumer confidence, reversing the decision to regulate would further exacerbate the situation. Public confidence in the safety of drinking water depends on a working regulatory process. ACWA appreciates EPA is finally moving forward with the regulatory process and urges EPA not to withdraw the regulatory determination. ACWA believes EPA should establish an MCL as close as feasibly possible to California’s MCL of 6 µg/L. In 2011, ACWA recommended the California Office of Environmental Health Hazard and Assessment establish a public health goal (PHG), California’s equivalent of a MCLG, for perchlorate of 4 µg/L (see Enclosure). ACWA members are confident that this standard protects vulnerable populations. ACWA encourages EPA to ensure the national MCLG provides similar protection to communities around the country.
