Subject: Association of California Water Agencies’ Comments Regarding California Water Commission Revised Draft Water Storage Investment Program Regulations Dated Nov. 22, 2016

Moving forward, the CWC should ensure that the WSIP is implemented in a timely and efficient manner. In order to enhance the Commission’s ability to consider funding the public benefits of storage projects that are diverse in type, scale, location and function, the CWC’s implementation activities should preserve the Commission’s full statutory discretion over allocation decisions for fundable public benefits, including public benefits associated with environmental mitigation measures and compliance obligations as provided under Water Code section 79753(b).

As the WSIP enters the implementation phase, the CWC should also closely coordinate with other state agencies with roles and responsibilities under Chapter 8, including the Department of Fish and Wildlife and the State Water Resources Control Board. This coordination will be critical if the WSIP is to realize its purpose of improving the operation of the state water system and providing net improvements in ecosystem and water quality conditions.
