Eminent Domain Policy Principles

In June 2006, ACWA released its “Eminent Domain Policy Principles,” a guiding document for the association when evaluating legislative or voter-initiative proposals addressing the subject of eminent domain.

The broad public interest requires that when the acquisition of private property is necessary for water projects, the acquisition must be accomplished through a fair and just exercise of the power of eminent domain that recognizes the public need and the constitutional rights of private landowners.

The seven policy principles outline ACWA positions on issues including “just compensation,” the economic realities of severance damages and the rules regarding uneconomic remnants, and redevelopment condemnations.
