2026 Proposed Bylaws Amendments

ACWA will conduct an electronic membership vote on the proposed Amended and Restated Bylaws. The electronic ballot process will mirror the process used to elect ACWA’s Board Officers and region boards, allowing all member agencies to participate, not just those attending ACWA conferences.

Each member agency is entitled to one vote, cast by its authorized voting representative. Member agencies must designate their voting representative by submitting the Voting Representative Form by Friday, Oct. 30.

Below are copies of the proposed changes to the Bylaws.

Voting Process

Voting will be conducted via email using an electronic ballot consistent with the voting process used by members to elect Board Officers and region boards. Voting representatives will receive their ballots from Simply Voting on Nov. 9 and have until Dec. 18 to submit.

Approval Requirements 

For the action to be valid, the number of votes cast within the voting period must meet or exceed the quorum that would be required at a meeting of the members considering the same action. Section 9.08 of ACWA’s Bylaws establishes 50 voting members as the quorum. 

Next Steps

1. Designate voting representative: Each member agency must submit the Voting Representative Form by Friday, October 30. Note: ACWA will also use this designee as the voting representative in the 2027 election for ACWA’s Board Officers and region boards for the 2028-’29 term. There will be an opportunity to change the designation prior to the deadline for nominating candidates if desired. 

2. Review proposed Amended and Restated Bylaws: See above dropdown.

3. Have designated voter prepare for the electronic voting: The designated voter will receive an email directly from Simply Voting on Nov. 9. Have them add vote@simplyvoting.com to their safe-senders list to ensure delivery of the ballot. Ballots must be submitted by Dec. 18.
