VOLUNTARY RELEASE AND WAIVER –

ASSOCIATION OF CALIFORNIA WATER AGENCIES (ACWA)

I am an adult over the age of 18 years and hereby request permission to participate in ACWA Region Event Tours (the “excursion”) organized by ACWA, a nonprofit organization, and by its directors, officers, agents and employees or by an ACWA Member Agency (hereinafter referred to as “Sponsors”).

I understand that I may be required to be on a variety of premises included on the excursion and in vehicles, whether motorcoach or personal vehicle required to complete the excursion.

I understand that by agreeing to this Voluntary Release and Waiver form, the Sponsors permit me to participate in the excursion on the following conditions, which are intended to ensure the safety of all participants, including myself, the Sponsors and all property:

  1. I promise that I will remain in the company of the Sponsors’ employees while on the excursion.
  2. I understand that the Sponsors will provide general safety information and practices for each facility or job site included on the excursion and that the Sponsors grant “permissive entry” to participants contingent upon his/her obeying the Sponsor’s rules, general safety information and practices, including but not limited to use of appropriate safety equipment, (e.g., vest, hard hat, safety shoes and glasses), and obeying all rules, requests and directions from Sponsor’s officers and employees. If I fail to do so, I assume all risks and assume all liability for any and all harm or injury to myself or damage to any property, which result from my failure to obey the Sponsor’s general safety information and practices and/or requests and directions from the Sponsor’s officers or employees.
  3. I release, discharge, and covenant not to sue any of the Sponsors for any and all claims, actions, and/or liability arising out of the excursion, my participation in the excursion, or during my visit to facilities and/or job sites included on the excursion, except those arising out of the intentional misconduct of the Sponsors. I make this release for all parties, including myself, spouse, personal representatives, heirs, successors, and assigns.
  4. I voluntarily have decided to accept all risks connected with my visit to facilities and/or job sites included on the excursion and my observation of any activities or operations on the excursion.
  5. I represent that I understand the inherent risks and dangers associated with participating in this excursion, and that I fully understand and agree to abide by all rules, general safety information and practices, and will obey all requests and directions from Sponsor’s directors, officers, agents and employees.

I HAVE READ THIS DOCUMENT AND UNDERSTAND IT IS A RELEASE AND WAIVER OF ALL CLAIMS. I UNDERSTAND THAT, BY INDICATING MY AGREEMENT WITH THIS FORM, I ASSUME ALL RISKS INHERENT IN MY VISIT TO FACILITIES AND/OR JOB SITES INCLUDED IN THE EXCURSION AND ACCEPT ALL OF THE ABOVE PROVISIONS.
