California regulations protecting wetlands and state waters were approved and will take effect on May 28, 2020. These new rules by the California State Water Resources Control Board create a more expansive and complex permitting scheme for developers, public agencies and others with projects that may impact waters and wetlands. In this Best Best & Krieger LLP webinar, Environment Law & Natural Resources Partners Andre Monette and Lowry Crook will discuss key components of these new regulations and strategies for navigating them to move projects forward. Participants will learn about significant changes in the rules, including:

  • a new and broader definition of state waters and wetlands that receive protections,
  • state permits for discharge of dredge or fill material into waters or wetlands,
  • in most cases, an analysis of alternatives that shows a project is the least environmentally damaging and
  • a minimum 1:1 ratio of compensatory mitigation for any unavoidable impacts to waters or wetlands.
